Provider Listing Terms

Last updated: October 2026

Version: 1.0

These Provider Listing Terms (“Provider Terms”) govern participation by eSIM suppliers, providers and commercial partners (“Providers”) in the eSIM Indexer comparison platform (“Platform”). The Platform is operated by the business identified in our Terms of Use (“Operator”, “we” or “us”).

Acceptance and scope

These Provider Terms apply when a Provider expressly accepts them in writing, including by email, or signs an agreement incorporating them. A person accepting on behalf of a Provider confirms that they have authority to bind that Provider. A listing compiled from public information does not, by itself, mean that the Provider has accepted these terms or entered into a contract with us.

Any separately signed agreement prevails over these Provider Terms to the extent of an express conflict. We may decline requests to join the Platform. A Provider must not rely on an expectation of approval, publication, ranking or continued participation unless expressly committed to in a written agreement.

Precedence of terms

Where a Provider expressly accepts these Provider Terms, they govern its listing and participation on the Platform in preference to conflicting standard terms published or supplied by the Provider, including website, feed or API terms, unless the parties expressly agree otherwise in writing. The provision of a feed, API, link or other materials does not by itself constitute our acceptance of additional or conflicting Provider terms. This provision does not override any separately signed agreement or any licence or restriction that is otherwise binding on us under applicable law.

Platform role

eSIM Indexer is a comparison, information and referral service. Unless expressly agreed otherwise in writing, we do not sell, activate, fulfil or provide the eSIM products listed, and we do not act as a Provider's agent, reseller or distributor. Participation does not create a partnership, joint venture, employment relationship or exclusivity.

Standard organic listings do not carry a listing fee unless separately agreed. We may earn affiliate commissions from qualifying referrals and may offer advertising or other commercial services under separate arrangements.

Accuracy of supplied information

Providers must take reasonable steps to ensure that information they supply or authorise us to obtain is accurate, complete, lawful and current, including prices, currencies, taxes and fees, data allowances, fair usage limits, throttling, validity, activation windows, destinations, networks, coverage, device restrictions, availability, refunds, cancellation rules and promotions.

Providers must notify us promptly when they become aware of material inaccuracies or changes affecting their listings. We may request clarification or supporting evidence, and may correct, hide or remove questionable information while reviewing it.

Prices and availability may change before a visitor completes a purchase. The Provider remains responsible for the final prices, terms and product information presented at its checkout. We do not guarantee that comparison information will always reflect the latest Provider information.

Feeds, APIs and integrations

Where a Provider supplies an API, feed, file or other integration, the Provider is responsible for its supplied information and for maintaining reasonable technical security. Providers should give reasonable advance notice, where practicable, of material changes to endpoints, authentication, schemas, availability or other integration requirements.

We may cache, validate, normalise, convert currencies and data units, categorise, summarise, translate, group, deduplicate, filter, rank and otherwise process supplied information to operate and promote the Platform. We may use editorial summaries or placeholders where information or assets are missing or unsuitable.

We do not guarantee acceptance of an integration, immediate updates, continuous feed availability or publication of every product. A Provider that develops or modifies an API, feed or integration to our published specifications does so at its own expense and risk. Compliance with our specifications does not guarantee acceptance, listing, continued integration or any commercial outcome. Unless expressly agreed in writing, we have no obligation to develop or maintain a custom adapter, provide technical support or reimburse integration, development, maintenance or other participation costs.

Delayed, malformed, incomplete, conflicting or unavailable feeds may result in inaccurate, hidden or omitted listings. The Provider should promptly report any such issue; we will consider appropriate corrections but cannot guarantee a specific resolution time.

Rights to provider materials

For the duration of participation and a reasonable technical wind-down period, the Provider grants the Operator a non-exclusive, worldwide, royalty-free licence to display, reproduce, distribute and reasonably adapt Provider-supplied names, logos, trademarks, images, descriptions and product data for operating, indexing, comparing and promoting listings on the Platform, including search previews and related promotional materials.

Reasonable adaptations include resizing, cropping, formatting and preparing summaries, provided we do not knowingly misrepresent the Provider's products. The Provider warrants that it has the rights necessary to supply these materials and grant this licence. Ownership remains with the respective rights holders. We may remove materials following a substantiated rights complaint.

Listing selection and rankings

We retain editorial, technical and commercial discretion over which Providers and plans appear, how information is displayed, and how listings are grouped, filtered, prioritised, ranked, featured, hidden or removed. We may exclude duplicate, incomplete, unsuitable or conflicting plans.

No listing guarantees a particular ranking, visibility, traffic, clicks, referrals, conversions, revenue or sales. We do not promise to list every product, promotion or variation.

Advertising and promotional placements

We may select, display, rotate, modify or withdraw advertisements, sponsored content and other promotional placements at our discretion, subject to applicable law and any separate written agreement. Placements may be provided with or without payment.

Advertising or promotional placement does not constitute a guarantee that the advertised products are the cheapest, best or most suitable. Unless expressly agreed in writing, participation does not entitle a Provider to advertising space, exclusivity, equivalent promotional treatment or any particular placement or commercial outcome.

Advertising and promotional content will be identified as required by applicable law. Separately presented advertisements are distinct from ordinary comparison results.

Affiliate and commercial arrangements

Listing alone does not create any listing fee, commission or payment obligation. Any affiliate rates, attribution rules, tracking requirements, payment thresholds, approval periods, promotional discounts or advertising fees must be agreed separately. Commissions are subject to the applicable agreed validation and attribution requirements, including any agreed treatment of cancellations, refunds, chargebacks or fraudulent transactions. Neither party guarantees referral volumes or commercial results unless expressly agreed in writing.

Customers and fulfilment

Where visitors purchase from a Provider, their transaction and contract are with that Provider. The Provider remains responsible for checkout, payments, delivery, installation, activation, connectivity, support, complaints, refunds, cancellations and compliance with applicable consumer and telecoms requirements.

Providers must not state or imply that eSIM Indexer guarantees, supplies or endorses their services unless we have expressly authorised that representation.

Compliance and complaints

Providers must not knowingly supply unlawful, fraudulent, malicious or materially misleading content. Providers must comply with applicable laws and respect third-party rights. We may investigate reports of incorrect listings, misleading offers, rights infringement or security issues and may request information before taking action.

Intellectual property and platform content

The Platform's original software, design, branding, editorial material and comparison presentation belong to the Operator or its licensors. These Provider Terms do not transfer ownership of either party's intellectual property. Providers must not copy substantial proprietary Platform content except as permitted by law or with our permission.

Third-party claims

To the extent permitted by law, a Provider will indemnify the Operator against reasonable losses, liabilities and costs arising from third-party claims directly caused by intellectual-property infringement in Provider-supplied materials, unlawful or materially misleading Provider-supplied content, or the Provider's material breach of these terms. This does not apply to the extent a claim arises from the Operator's negligence, unlawful conduct or unauthorised alteration of materials. The parties will cooperate reasonably in handling such claims.

Cybersecurity, data integrity and service recovery

The Platform and its integrations may be affected by cyberattacks, unauthorised access, malware, vulnerabilities, hosting or network failures, human error, third-party incidents, or other events beyond reasonable control. We do not guarantee that the Platform, its systems or stored information will always be secure, uninterrupted or free from loss, corruption or unauthorised alteration.

Supplier feeds, listing records, integration settings, analytics and other non-personal operational data may become unavailable, incomplete, corrupted, delayed or lost. We may maintain backups and undertake recovery efforts, but do not guarantee that any particular record can be restored or that recovery will occur within a specified period.

We may temporarily restrict access, disable integrations, suspend listings, rotate credentials or take other proportionate steps where reasonably necessary to investigate, contain or remediate a suspected security or data-integrity incident. We will comply with applicable legal obligations, including those concerning personal data and required breach notifications.

To the fullest extent permitted by applicable law, any liability to a Provider arising from a security incident, data loss, corruption, unauthorised access or recovery interruption is subject to the exclusions and single aggregate liability limit set out in these Provider Terms. Nothing in this section excludes liability or statutory rights that cannot lawfully be excluded or limited.

Exclusions and limitation of liability

Nothing in these Provider Terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

Subject to the preceding paragraph and to the fullest extent permitted by applicable law, the Operator excludes liability to a Provider arising out of or relating to the Provider's listing, participation or integration, including claims concerning feed or API failures, inaccurate or delayed supplier data, interrupted Platform availability, listing or ranking decisions, changes to promotional placements, removal or suspension, third-party search results and the absence of referrals or sales.

To the fullest extent permitted by applicable law, the Operator shall not be liable to a Provider for loss of profits, revenue, sales, anticipated savings, commissions, referrals, contracts, business opportunities, goodwill or reputation, or for indirect or consequential loss, whether the claim is framed in contract, tort (including negligence), misrepresentation (other than fraudulent misrepresentation) or otherwise.

Where liability to a Provider arising from or relating to its participation in the Platform cannot otherwise lawfully be excluded but may lawfully be limited, the Operator's total aggregate liability to that Provider shall not exceed £10 (ten pounds) in total for all claims combined arising out of or relating to the entire participation relationship. This is one cumulative limit, not a limit per plan, listing, transaction, event, allegation, claim, claimant representative or legal proceeding. Related or successive claims do not reset or multiply the limit. The limit applies only to the extent it is lawful and enforceable, and does not create any entitlement to payment or admission of liability.

This section does not limit a Provider's obligations to the Operator, including obligations concerning supplied information, third-party rights, confidentiality or indemnification. A separate written commercial agreement may specify different liability terms, which will prevail to the extent of an express conflict.

Suspension, removal and termination

We may restrict, suspend or remove listings where reasonably necessary for legal, security, technical, editorial, compliance, quality, commercial or operational reasons, subject to any separate agreement. Providers may request removal by contacting us; we will review reasonable requests and act within a reasonable period, taking account of applicable law and existing obligations.

Unless expressly agreed in writing, the Provider is not entitled to reimbursement of its own costs or compensation merely because a listing or integration is rejected, changed, suspended, discontinued or removed in accordance with these Provider Terms, subject to applicable law.

Removal from the live Platform does not ensure immediate removal from search engines, external caches, archives or previously generated previews. We may retain information where reasonably necessary for legal, security, accounting or dispute-resolution purposes, subject to applicable law.

Termination does not extinguish rights or obligations accrued before termination. Provisions concerning intellectual property, confidentiality, third-party claims, liability limitations, governing law and other matters intended by their nature to continue shall survive termination to the extent applicable.

Confidentiality and personal data

Each party will take reasonable steps to protect non-public business information identified as confidential and use it only for the relevant relationship. This does not apply to information already public, independently developed, lawfully received from another source or required to be disclosed by law.

Each party must comply with applicable data protection law where personal data is exchanged. Where required, the parties will enter into an appropriate separate data-processing or data-sharing agreement.

Changes to these terms

We may publish revised Provider Terms. A new version does not automatically amend an existing Provider's agreement merely because it is posted online. We will notify participating Providers of material proposed changes and obtain acceptance where required by law or contract. The effective date and version shown above identify this document.

Governing law

These Provider Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, subject to mandatory applicable requirements.
